TOLTEC
offer mediation for commercial and civil disputes, with particular
reference to allegations of bullying in the work place. We are independent
and impartial.
The
strength of mediation is to solve a problem without apportioning blame.
The mediator is not a judge or an arbitrator, but is there to listen without
the threat of publicity. It is confidential.
The parties have the opportunity to give their side of the story, without
interruption, around the same table. This can be expanded during the private
sessions.
Having
heard the facts, the mediator is able to help both sides identify the
real reasons for the dispute.
If a settlement is
achieved it is because the participants have reached an agreement themselves
without imposition from others.

- Mediation sessions
can be set up quickly, which is less expensive than normal court proceedings
and less stressful.
- It is voluntary,
non binding to the point of agreement, and without prejudice. The procedure
is flexible, non confrontational and can be modified to suit the circumstances
of the case.

of the dispute helps to understand the other’s position, which
could help to bring about a settlement.

is an acceptable resolution of the problem, by all parties.

of sick days taken caused by stress.

Example
of the benefits of mediation
J, a new entrant,
dropped a grade to gain experience in the A&E department .
M, her head
of department, recognised that J has experience to bring to the
job, but resented it. The break down of communication between them
resulted in loss of confidence for both sides. This is had a detrimental
effect on the whole team. It was established that misinterpretation
of body language was the cause. Once this was understood the working
relationship between the two parties and the department took on
a completely different atmosphere. |
